Picture is Worth 1,000 Words. Take photos after your accident! Take them close up, take them from far away. Take multiple angles. Do not assume someone else is going to do it. Do not assume the accident report will be good enough. Do not assume the witness information will be saved somewhere. It is up to you to gather the evidence at the scene of your own accident.
We tend to take it for granted that we can describe how the scene looked.
What did the ice look like?
Did you slip on ice or snow?
Was the entire step covered? Or was there a patch of ice?
Did it look like someone tried to shovel it?
Was there salt or sand thrown on top?
You can’t be sure what details are important to your claim. You don’t know who the insurance company is going to produce as a witness to say that it was all shoveled with salt thrown on top.
