Are there time limits to sue for injuries in a New York spinal injury case?

Spinal injuries are like all other injuries in New York. The time limit to bring a lawsuit against the private party is three years, to bring a lawsuit against a municipality is one year and 90 days plus a 90-day notice of claim, within 90 days after the accident. If you’re a minor then you have until age 18 before your time starts to run, although the 90-day notice requirement for a municipality is still in effect from the date of the accident.

If there is a wrongful death element to the claim, where the injured party has deceased, then the lawsuit for the wrongful death has to be filed within two years against both a municipality, and the private defendant.
